Return Policy

Return Policy for Original Artwork   My Return & Refund Policy for Original Paintings I want every collector to feel completely happy with their purchase. If you’re not fully satisfied with the original painting you bought from me, you may return it within 7 days of delivery. I’ve outlined the steps below to make the process clear and fair for both of us. Return Eligibility You have 7 calendar days from the day the painting is delivered to request a return. To start the return process, just contact me via the contact page with your order number, a brief explanation, and photos. The painting must be returned in the same condition it was received, without any damage. Refund Details Once I receive the returned painting and confirm that it’s undamaged, I’ll issue a full refund for the painting price. Please note: Shipping fees are non-refundable, and you’ll need to cover the return shipping cost. If the painting arrives back damaged due to improper packing, I won’t be able to process the refund. How to Pack the Painting for a Safe Return Please follow these steps carefully to make sure the artwork returns to me safely: Place a flat, sturdy sheet of cardboard on both the front and back of the painting. Include the Certificate of Authenticity in the package. Thoroughly wrap the entire painting securely with multiple layers of bubble wrap, just like you received it. Once wrapped, Wrap the entire package with strong packing tape, sealing all edges. Clearly mark the package with FRAGILE stickers or writing. Use a trackable, insured shipping service to return the painting. Contact me for the return address. If you have any questions or need help with the return process, I’m here to help. Thank you for supporting original art, and for treating each piece with care and respect.

Copyrights & Ownership

Artist / Copyright Owner: Hanz Human (“Artist”, “we”, “us”) 1) Definitions Artwork: Any original painting, drawing, design, image, composition, or artistic work created by the Artist (including titles, concepts, and preparatory works). Products: Original paintings, physical prints, framed prints, HD digital images/downloads, merchandise, and NFTs relating to the Artwork. Copyright: All rights protected under the South African Copyright Act 98 of 1978, including rights of reproduction and other restricted acts. 2) Copyright ownership stays with the Artist Unless you have a written agreement signed by the Artist that clearly transfers copyright, the Artist retains full ownership of copyright in all Artwork and Products, even after sale. Buying a Product does not buy the copyright. You are purchasing ownership of that specific copy/item only. 3) Moral rights (attribution & integrity) Regardless of any sale, the Artist retains moral rights under South African law, including: the right to be identified as the author (credit), and the right to object to derogatory treatment/modification that harms the Artist’s reputation. 4) What you MAY do (general) Unless these terms say otherwise, you may: Display the purchased physical item in your home/office. Resell the item you lawfully purchased (e.g., sell the original painting or a print you own). Resale is allowed because you own that lawful copy/item. (Resale does not grant reproduction rights.) 5) What you MAY NOT do (no duplication / no mass production) Without the Artist’s prior written permission (a negotiated licence or assignment signed by the Artist): reproduce/copy the Artwork (including scanning, tracing, photographing for print, or digitising for redistribution); create prints, posters, canvas reproductions, “print-on-demand”, or mass produce any version; use the Artwork on merchandise (shirts, mugs, posters, packaging, stickers, etc.); use the Artwork for branding, logos, advertising, social media ads, or commercial campaigns; mint or re-mint the Artwork as an NFT, or use it in any tokenised/derivative NFT project; create derivative works (edits, filters, AI training, redraws, animations) for anything beyond private personal use. 6) Product-specific terms A) Original Paintings (physical originals) You receive ownership of the physical original only. Copyright remains with the Artist. You may resell the painting you own, but you may not reproduce it or authorise reproduction without a written licence. B) Prints / Framed Prints (physical) You receive ownership of the physical print item only. You may resell that print item. You may not scan, copy, reproduce, or create further prints. C) HD Digital Images / Downloads Unless otherwise stated on the product page, HD image purchases are licensed as: Personal-use, non-commercial, non-transferable licence to download and view the file for personal enjoyment. You may not: share, upload, redistribute, sell, sublicense, or “gift” the file; print or reproduce beyond what is expressly allowed on the product page (if printing is allowed at all); use the file commercially (including marketing, product designs, websites, ads, NFTs, or print-on-demand); use the file to train AI models or generate derivative content for distribution. D) Merchandise (wearables, homeware, accessories, etc.) You own the physical merchandise item only. The Artwork/design printed on the merchandise remains copyrighted by the Artist. No copying, replication, or commercial use of the design without written permission. E) NFTs Purchasing an NFT generally transfers ownership of the token (and any smart-contract-defined rights), not copyright in the underlying Artwork, unless a separate written agreement states otherwise. Unless explicitly granted in writing by the Artist, the buyer receives a limited, non-commercial display licence to display the associated Artwork for personal, non-commercial purposes (e.g., personal gallery display, wallet display, personal social post showing ownership). No commercial exploitation, reproduction, merchandising, or sublicensing is granted without a separate signed licence. 7) Licensing & commercial permissions If you want to: mass produce, print commercially, use on merchandise, use in marketing, or obtain any commercial rights, you must contact the Artist to negotiate a written licence (or assignment) signed by the Artist. 8) Enforcement & remedies Unauthorised copying, reproduction, distribution, commercial use, or tokenisation may constitute copyright infringement under South African law. We reserve the right to pursue appropriate remedies, including takedown requests, cancellation of licences, and legal action where necessary. 9) Governing law These terms are governed by the laws of the Republic of South Africa, including the Copyright Act 98 of 1978. 10) Contact For licensing, permissions, or rights enquiries contact me via the contact page. “All rights reserved. No reproduction, copying, redistribution, print-on-demand, AI training, or commercial use without a written licence signed by the Artist.”
